Job Summary
To receive representations that serve to challenge decisions made in relation to the homeless applications in accordance with the Council’s duty under the Homeless Reduction Act 2017 and carry out an independent review of such decisions, producing a written adjudication on that substantive challenge that serves to consider and supply the full reason for the review decision
* To conduct reviews of suitability of accommodation provided or offered to homeless households in accordance with the Council’s statutory duties under Homeless Reduction Act, decisions on homelessness applications.
* To conduct appeals against housing register decisions and council tenancies such as fixed term tenancy reviews, introductory tenancies
* At the direction of the Housing Solutions Manager, to act as the council’s representative in any subsequent court challenge to review decisions or in any litigation around the conduct of the review, including that which involves any decision not to conduct a review.
* To ensure customers receive, either directly or through referral to relevant teams/agencies, appropriate advice on their options.
* To ensure that all enquiries and cases are progressed speedily and efficiently, that all set targets are achieved and to minimise the risk of successful legal challenge on decisions relating to the allocation of accommodation to homeless households.
* To produce independent decisions relating to reviews registered under the relevant section of the Homeless Reduction Act, challenging the suitability of accommodation provided in accordance with the Council’s statutory duties to homeless applicants.
* To carry out all casework for County Court challenges to review decisions, drafting witness statements, liaising with the Council’s Legal Department and attending court
